    I think you are overreacting. All I-130 submittals are passed on to the NVC. The point I tried to make in previous messages, however, is that it doesn't matter if your documents are at the NVC. You can just ignore the NVC requests for fees and proceed with Adjusting your status in the U.S, with form I-485 and supporting documents.

    I'm sorry you thought earlier that you were "wasting your time on this forum," but responses you may get from this forum are from people who have been through these immigration procedures and can speak from their experience completing what you are trying to do.

        Adrienn,

        You won't have an Alien Number ("A" number) until you have a Green Card.

        If you are being processed in the U.S.,you won't have a Green Card until your I-485 submittal results in an Adjustment of Status interview.

        If your I-485 was submitted correctly, the interview usually occurs about six months from when your I-485 package and I-130 forms were submitted.

          I 485

          My next question is ...we filed for my son with my paperwork but of course invidual I meant same envelope I 765 ,i 485, i 131 .we are in us he is 15 years old .uscis sent back his paperwork ..missing something.we need to resubmit ....we did not file invidual the I 130 for him because he is a dependent...I should of attach to his paperwork my approved I 130?

            If the petitioner is a U.S. citizen, the child needs to have an I-130 submitted for him. You can include the I-130 with the I-485 paperwork, and the $420 fee.

              Thank u. The letter says exactly " send i 130 or other evidence than an immigration visa petition has been filed/approved on ur behalf" what is this mean exactly? I thought I can send mine

                If the petitioner is a U.S. citizen parent of the child, a separate I-130 needs to be submitted for the child. Is the petitioner your husband or you?

                        Then you also have to submit an I-130 for your son. Since the son's I-485 package was rejected and returned to you, you must resubmit the I-485 and I-130 packages with the full $1,070 (or $985 if under 14 or so, not sure of age), and also $420 for his I-130.

                        The son is not eligible for a dependent/derivative visa, since your status is "Immediate Priority,: and he must be petitioned separately unless you were a "quota wait" status (petitioned by a Green Card holder).

                            I've told you what is wrong and what you have to do. If you want to seek a second opinion by a USCIS Help Desk person over the phone, be careful that you explain your status very carefully, because their answers are often based in misinformation received from phone queries.

                                The only way you are going to fix this is resubmit the I-485 and the I-130 together, with the correct fees (depending on age of your son).

                                If your child is under 14 year of age, $635 would have been the correct fee for his I-485, if submitted with your I-485 package. But now, since his submittal was rejected, his I-485 fee is $985. If the child is 14 or older, his I-485 fee is $1,070, whether submitted with your I-484 or separately.
