Do I need to extend my I-94? I was paroled for one year and my I485 is pending

    Hello everyone,

    Please help me to understand what I should do. It seems a little bit blur to me how the immigration system works.

    I came into the usa last year using my older EAD/AP combo card which expired and I was paroled for one year. My current I-94 will expire in the next month (September). The reason for being paroled was AOS. My I485 is still pending and I have no visa at all right now. I am here only because I am applying for the green card. I also have as a consequence for applying for my green card obtained an EAD/AP combo card which will expire on February of 2015. Now does that mean holding a combo card means I do not have to worry about the I-94 expiration date anymore? or I must apply for extension of stay using form I-539.

    If I must apply for an extension then I am wondering under what category. after reading the instruction document for I-539 I don't see anything related to my category of holding an EAD/AP combo card and having a green card application pending. I am worried I would run out of status or something similar and face trouble later so I want to stay on the safe side and quickly figure this out.

    PS. As I was applying for a green card it turned out it is going to take much longer than it should. My I 140 still have not received a decision as of now 9months has passed.

    I'm also running in the same boat. What did you do ? Did you get your I94 extension.

    I'm currently on EAD status (AOS; 485-pending) which is expiring on Feb 13th 2015. I went to India last year on December 12th 2013 and came back on Dec 29th 2014. My I94 was stamped for just one year and is expiring on December 28th 2014. I'm already due for extending my EAD/AP which is expiring on Feb 13th 2015.

    Do I need to extend my I94 (by filling I539 form or so) or do I need to just file for EAD/AP extension which I can do now (120 days before expiry). What if I did not get EAD/AP before Dec 28th ? In that case, do I need to file for some extension on I-94???

    I have to travel to India again in Feb 2015 and would appreciate your feedback since I'm running out of time on I94 extension. I am worried I would run out of status or something similar and face trouble later so I want to stay on the safe side and quickly figure this out.

    Please advise !!
