  • can someone please help me????

    I had lived for an year overseas where I married my husband. Recently he came to the states on an H2B visa and now I am trying to apply for his permanent resident card( I am a US citizen). I just returned to the states myself recently and I do not have a job yet but my husband does. I had filed out I-864 as me the main sponsor but used his income. Now I have a few dilemas:
    1. Since he only has the visa until 30th of November do we need a joint sponsor? we do meet the poverty line
    2. If I do need the joint sponsor does he need to file I-864 and I-864 A? we do live with my parents and my dad will be the joint sponsor.
    3. I had read on the forum something similar to my case and it said that I should include and explanation of me not having a job. Do I need to do that? If yes should I attach a sepparate piece of paper with the explanation?

    Lavi,

    You will need to provide an attachment explaining why you did not file an income tax return for the most recent year. Your lack of employment does not need t be explained, but lack of an income tax return does require an explanation.

      Thanks for the answer but I did file my Taxes for 2013 and I will attach those and 2011,2012. I did work in 2013 until june.

        Okay, then you include copy of your 2013 tax return, but report your current status as unemployed in the appropriate section on the I-864.

        You do not need to include copies of 2011 and 2012 tax returns with your sponsorship documents.

          I understand I will include just the 2013 taxes and yes I did mark unemployed in the form, now do I need the joint sponsor? My husband got an employment letter from work stating that after he is aproved his job will be permanent where he works. Thank you in advance, Lavi

            If you have no proof of ongoing employment and income, you need a co-sponsor.

            If your husband is not currently eligible to work, he cannot be his own co-sponsor.

              He is autorized to work in the US until Nov 30th and the employer gave us a letter of employment stating that once he gets his aproval from immigration he will continue employment with them full time. Is that enough?

                It sounds good. Put him on the paperwork as a household member co-sponsor (I-864A ).

                    help again!

                    Can I get some help again? So I sent the paperwork in and everything went well until now. I have received a letter for request for initial evidence. I did what we discussed about but now they ask to send again proof of legal work in US after I send a copy of i-94, copy of visa, copy of petition, letter of employment, and completed the social security where requested. Besides they ask for the most recent tax year for him since he is the one with the income, but he just came to the States in May. How can I send that???? no logic. Will you please let me know what should I do about this? Thank you so much in advance. Lavinia
