My Spouse entered US on L1 visa in 2012, and I entered US in March 2014 on a L2 visa (valid till 2017). Her I-140 petition was applied by her organization on May 7th, 2014, and approved on Aug 11th, 2014. Meanwhile, I needed to travel back to India on an urgent basis, and left US on July 29th 2014. In my absence, the EAD+AP card arrived for us in US, and I have received mine here in India.
Her I-485 has been approved on Aug 11th, 2014, and my status is showing as "Acceptance".
The topic I need some clarifications on is this :
1. I was planning to re-enter US in Sep 2014 on the basis of my L2 visa, and also show the AP card to the CBP and ask myself to be entered as a parolee. However, if my spouse gets her Green Card before I re-enter, I understand that her L1 visa will become defunct, and therefore, my L2 visa will become defunct. - Is this a correct understanding?
2. If so, what Visa would I be required to present at the time of entry? Or will my L2 still be good enough? Or my AP document itself is good enough given that my I 485 has been applied for on May 7th?
3. If my I-485 gets approved before I land back there, does that imply that I will not have any issues entering the US back ?
4. My final question (I promise) .. If I request my spouse to delay her I 551 stamping till such time that I am in US, does that keep her L1 visa and her status as non-immigrant active? If so, till such time, my own L2 visa remains valid? Is that a advisable strategy in order to keep her L1 status alive?
