  • Conditional Greencard/Conditional Permanent Residence

    hello everybody, hope im posting in the right section... if not pls let me know..
    our case, adjustment of status is under marriage, US citizen.
    so i have couple questions regarding Conditional Greencard/Conditional Permanent Residence that is for 2 years.
    as of today the August 18th we been married for 2 years and half, and we filed AOS on Dec. 2013 and on April I received work permit EAD
    finally we will have our interview for the AOS/Greencard in 2 days.
    so our question is, since we have been married over 2 years (by the ways we don't have kids) will we get a greencard for 10 years at the interview/when they approve it?
    i mean i don't wanna look cheap but who wants to pay around 500 bucks? so i dont know why i get the idea that we will get the conditional greencard and if so, would it be rude or not or okay to ask the officer whats up with what i read online (of course asking nicely/proper way)
    so this is what i read
    **** An exception to this rule is the case of a U.S. citizen legally sponsoring a spouse in which the marriage at the time of the adjustment of status (I-485) is more than two years old. In this case, the conditional status is waived and a 10-year Permanent Resident Card is issued upon USCIS approval of the case. A permanent resident under the conditional clause may receive an I-551 stamp as well as a Permanent Resident Card.***

    **** Your permanent residence status is conditional if it is based on a marriage that was less than 2 years old on the day you were given permanent residence.***

    The law is the law; what ever it says, is expected to b done. All the best.

      Normally, if your marriage date is greater than two years from when you are approved for a Green Card, you can expect to receive a 10-year Green Card.

      USCIS reviewers make mistakes in both directions (issue 10-year cards to ineligible applicants and 2-year cards to those who have been married more than two years at interview). If your resultant Green Card seems to be contrary to the USCIS standard, submit an I-90 for a corrected card (no fee).
