  • AOS pending app but I may move to Overseas, help!

    Hello,

I'm a federal government empolyee (hence US Citizen). My newly wife submitted her AOS back in July 28 and has her biometrics scheduled Aug 27. I recently got an offer from US Army Base in South Korea as civilian engineer and want to know what I should do about her pending AOS application. I'm going to be working as US Citizen in South Korea. Do I just change the address and get her interview done at US Embassy in Korea? Since this is a unique situation, will USCIS be able to expedite my case via military-option? Not sure if I should wait until she gets her Green Card (I expect by end of October) then make my move to Korea in November...

Anyone with experience can help? Thanks!

I'm not aware of any military option for your wife to be interviewed for her Green Card outside the U.S. I have seen an applicant for "Removal of Conditions" for her 10-year card get approved while with her civilian military employee in Europe, and have her fee waived, but that's not the same thing.

You will have to be at the Adjustment of Status interview. Complete the Biometrics, then request an expedited processing of your wife's Adjustment interview because of your job with military overseas. But you will need proof of the job approval before you attempt to obtain priority Adjustment processing.
