  • I-360, petition for Widower.

    I entered the United States on October 5, 2008, as spouse of US citizen, unfortunately, my wife died in August 20, 2009, and my marriage was less than 2 years.

    I reentered to my homeland in December 31, 2009 because I was in the U.S for her,

    I’ve read that a new law FY2010 DHS was passed by Congress which let me file Form I-360 for Special immigrant classification as a widower.

    Now that the thoughts have decreased and the pain is less painful, I want to immigrate as the widower of a U.S. citizen. What should I do? What exactly do I have to do to qualify for the benefits of this law!

    Toufik,

    You are only eligible to use form I-360 as a widow/widower if your spouse passed away within the last two years.

    When your wife passed away in 2009, you were then eligible to obtain your 10-year card (if you had a two-year conditional card at the time), but that eliibility has now passed.

      Toufik, so sorry for your loss. Even though u were grieving, I wish u were able to investigate, to know u would b able to obtain further status, even though your wife had passed. All the best to u.

        The poster had options to remain in the U.S. when his wife passed away in 2009, but left the U.S., abandoning those options. He has now waited too long to be eligible for a widower visa, and is no longer eligible.
