  • Move to Overseas while I-485 is still pending

    Hello

I work for US. Department of Defense as civilian employee. I recently got an offer from overseas military base as civilian. My wife came to USA via K-1 and we got married recently. We applied for I-485/131/765 and she went to get her fingerprints late August.

I've talked to USCIS and they said we can submit the official letter as proof for expedited request -- there's still chance this may not get accepted.

    My question is
    1) If we get accepted for expeditied request for I-485, how quickly can she get her permanent residency?
    2) If denied, what should we do to make sure we move to Korea legally and come back to USA 3-5 years later? Do we have to re-submit the I-485 in Overseas from ground?
    3) Can we continue on our I-485 application normally in Overseas, do our interview there and get her permanent residency? I'll be working in US military base.

Can someone please advice what I should do?

Hi. My husband and I are in a similar situation as you and your wife were. I was wondering how long did it take to get approved after you expedited the 485?
    Any help would be appreciated.
    thanks

They will grant ur wife the permanent due to your sophisticated job. Your wife can not travel out of the US with approval of the permanent resident. She may not be able to come in to the US If she leave without parole or green card. So request for the expedite for the green card, they will grant her the request. Good luck

I did requested for expedite on April 2nd and faxed them proof of PCS orders on april 11th. So far Travel Document (131) and EAD got approved but 485 is still on "case is ready to be scheduled for an interview"
I was hoping interview would get waived since we only have 3weeks till we move to Germany.
