  • I-94 for B-2 near expiration date need advice for filing for adjustment of status

Ok here is the situation... I have been traveling to the Us on a B-2 class visa from 2004 - 2014 (10yrs). I came to the US in the beginning of april 2014 initially for a very short trip to visit family but then I met a woman and every time my intended return date approaches we would become very sad and I end up postponing it until I decided I will give the relationship time to grow a little, we spent everyday courting. I told her my b-2 expires in June and my I-94 expires in early October so I was always double minded about going home. She was unemployed, in debt and going through a lot of abuse with her family. I started to help her turn her life around she got a job, a place, payment plans for her debts and we ended up moving in together in june as she was kicked out and my family got a little tired of my 2 mnth extension on a 2 week trip. We got married in july and now its September and she just managed to save enough to file form I-1485 as I wasn't working and my savings from home was used to pay the rent. We are filing G-1145e, I-130, I-485, I-765, I-131, G-325A for the petitioner and for me, and I already have a sealed I-693. With regards to the I-864 she makes on paper $20,000 a year (enough for a 2 member household... I think) but in reality its still a struggle because she is starting from scratch and I am down to scratch after making her situation mine and investing in it.
I want to get everything right because I have always been in good status with US immigration but we just can't afford a lawyer and I feel like time is winding down so I took to the forum for advice.

Should we seek joint sponsorship? (Its available)
What is my status with the USCIS?
Am I Filing the right forms?
Am I going about it the right way?

    Thanks in advance!

    Vava,

You are approaching this correctly and your plan will usually work.

Joint sponsors will be accepted, though your wife must still be the primary sponsor.

The expiration of your B2 visa and I-94 will be tolerated by your marriage to a U.S. citizen and your status becomes "protected" during your Adjustment processing.

Standard fees for an attorney to handle this procedure are $1,500 to $2,500. Since you have done your homework, have listed the correct forms, and are seeking answers to very specific processing requirements, paying an attorney to complete your forms would be overkill and unnecessary, but would certainly help the attorney pay down his student loan fees and brag about how much he is helping people (as he pockets your $2,000 for about two hours of clerical work).
