  • Someone helppppppp!

    Long story please bare with me!
    Ok..I was born in Germany..legally came to the United States when I was two in 1992 with my mom and step father who did not legally adopt me. He was military and we came here through him...my crappy parents let all my stuff expire which I believe I was 6. They divorced never fixed my situation ...he still didn't adopt me but was granted custody of me. Still never took care of it. So then when I turned 17/18 an I wanted to a license I don't have the proper materials..I've talked to several people one person who has contacted someone says I have no status ..so im not legal but not illegal. We've filed several things but all seem to be the wrong thing..I am currently 25 years old married five an half years with two kids and stillllllllll no license ...there's got to be something someone knows that can help me and point me in the right direction!?

    What have you attempted to file, and what were the outcomes?

    Are you married to a U.S. citizen?

      In 2008 i-751 it said my resident status was extended not really sure what happened with that I was 18/19 doing this on my own because my parents were super in helpful. 2009 I have a letter saying biometrics for an i90..I remember going to that appointment but I didn't have the proper identification I believe also in 2009 I went to the German consulate an got a temporary passport thought that would get me a license but didn't have some stamp ...I am married to a us citizen we keep goin in circles on what to do with no help

          Your first step should be to find out what your current Permanent Resident status is, whether okay or abandoned. You will need your "A," number (Alien Number), to find out.

          Your I-751 would normally have been used to extend a two-year Green Card, but you would have had to follow through and eventually been interviewed for it.

          Your Biometrics for an I-90 was probably the result of your requesting a replacement Green Card, which probably meant that you had reason to believe, at the time, that a 10-year Green Card had been issued for you, but you never received it.

          But if all else fails, .... if you are married to a U.S. citizen, you have a new starting point, which is a basis for reestablishing Permanent Resident status, which would eventually require a new I-130, immigrant petition, and I-485, to adjust status to a Green Card.

          Please tell me if you understand any of the above or if you disagree with what I wrote above.

            Thank you so much. I do understand..I pretty much wanted confirmation that the I-130 && I-485 are what we needed. But have a couple questions for you? 1.lets say those get denied for whatever reason...would he be able to file for extreme hardship? 2.who do I contact about finding out my status?

            I'm so emotionally drained from dealing with this and scared to out more money into it to be shut down once again...but it's starting to effect my kids life can't even drive them to school hope this time around is different

              If it can be established that your Permanent Resident status is still valid, you won't need to be repetitioned by your husband. Your first step, then, would be to ask of USCIS whether your Alien Number can still be tracked and confirmed. Do you still have the original or copies of your earlier Green Cards? Do you have a copy of the I-90 you submitted in 2009? Or do you know what resulted from that submittal?

                Okay I just tried to call USCIS and was unsuccessful..do you know specifically who I can call to try an find out about my alien number being tracked n status? I do not have my green card I asked my step dad an mom they both blame each other as to who had it last :/ but my I-90 paper I have here in front of me an it is saying I needed to attend the appointment giving for biometrics..which I went to and then I'm pretty sure I was turned away for not having proper identification.

                  When you say below that your call was "unsuccessful," what does that mean? Did you reach a live person? Did that person understand your question? Or were you unable to reach a live person?

                  Does your I-90 have your "A" number, your Alien Registration Number?

                  Tell me first if you have the "A" number on the I-90 copy, then I'll suggests your next step.

                    I reached a live person and asked her about the status of my I-90 she is mailing me a denial letter since I never received anything after the biometric appointment. I did also ask her where I could I find out my legal status she wasn't very helpful with that...but one of the few things I do have is my a number thank god..I have that an my original paper passport from when I entered the us.

                      When you get the I-90 denial letter (if it shows up), post the reasons indicated for the denial.

                      On what part of your passport was the "A" number? In the entry annotation or on a visa? Can you tell us the visa class? and date of entry?

                        I wish I could somehow show you. I'm looking at it the majority is all in German and have no idea what it says. But I only see my a number on it once written in pen on the back ..and stamps that say... Aug 4 1992 admitted ((then written in pen says CR-2)) also written in pen aug 3 1994 then my a number ...then a stamp that says "processes for I-551 tempory evidence of lawful admission for permanent residues valid until feb o3 1993 " not sure if any of that is helpful to you!

                          Okay, that makes sense regarding your entry status. You had a two-year Green Card, probably received a few weeks after you arrived, and it would have been expected that you submitted an I-751, "Removal of Conditions," before Aug 1994 to obtain a 10-year card. Your 10-year card would have been good until 2004, at which time you would have had to use the I-90 to apply for a new 10-year card.

                          What doesn't make a lot of sense is why you submitted an I-751 in 2008, which was way beyond the date that the first I-751 was due.

                          My advice, given the information you have provided, is as follows:

                          1. Wait until you get the I-90 denial letter, and see if it was a denial for an irrevocable termination of your status.
                          2. If the denial letter does not indicate a USCIS action that had terminated your Green Card status, but was because you had failed to provide some evidence, you should submit another I-90 to obtain a new Green Card. That I-90 will cost you $450, but you can initially submit it with no fee, to report that you never received your Green Card. It may then be returned to you asking for the $450.
                          3. If either of the above actions are rejected by USCIS because they consider your status to have been abandoned, your next step is for your husband to submit an I-130 for you, with a submittal fee of $420. You could also submit the I-485 at the same time, with fee of $1,070, but because of the unusual nature of your status history, my advice is to get the I-130 approved first, before investing the second fee and cost of an immigrant medical exam.

                            Yea when I did all this in 2008 I was like 18 an really had no help and probably was told by someone who also had no idea and wasted that money ..so ok when I get the letter they said will take up to ten days I will let you know. But if for whatever reason it was it was denied because of evidence are u saying I don't have to resubmit the fee ...or I have to pay another $450?

                              Let's see what the denial letter details. When submitting an I-90 for a Green Card that never arrived, submitting without the $450 fee might work if USCIS sent the Green Card and it was returned. But submitting without the fee first time "doesn't cost anything."
