i864 5x or 3x for assets

On the uscis website it says if you're using assets the assets must equal at least 5x the difference of income. It continues to state that an exception to this is when a spouse or child of a U.S. Citizen, then only 3 times the difference is required.

Why then did I not meet the minimum???? All my paperwork went through and when I met with a uscis consular they said it was supposed to be 5x.i thought that perhaps under the stress of everything I misread.

I went back home and NOPE it's supposed to be 3x

The instructions do say "3 times" deficit of income proof for asset substitution, but various USCIS staff differ in review and approval of such substitution, or don't understand the rule. You don't have a solid basis to argue the point and gain an acceptance of what you offered, as asset substitution is not handled or understood very well by anyone.

What asset type are you offering in lieu of income proof? Real estate, vehicles and collections will not meet with acceptance. It's better to offer more cash than less. Broker statements of mutual funds, stocks, are good, if the value on current statements is significant more than 5 times the income requirement.
