  • Marriage based interview tomorrow

    Hi guys, I have the AOS through the marriage tomorrow. I have a question about how slightly there is a chance that they will separate us to different rooms?

    Story is here:

    I was married for two years to a Russian Girl(not us citizen), she applied for political asylum, but we never got our interview. After I found out that she was cheating on me while I was at work. I applied for divorce, while divorce was in a process I met African-American citizen girl, we were going through the same situation (she lost her loved one and I was going through divorce) so we came along. Started talking and dating. Later we got married, and now we have the interview. And I was arrested twice because of tickets that I got for riding bicycle. I have my dispositions that I served community works.

    What do you think is it enough red flags to separate us and ask separate questions?

    Are you being petitioned by the African-American lady? Since your earlier experience was with a Russian lady immigrant, your status is not clear.

      Hello Rayb, Yes I'm being petitioned by the African-American lady. We have 3 years age difference, I'm 25 - she is 22. I came into this country on F1 visa at 2007 (december), I was on status till I got married for first time - then she sucked all money that my parents used to send me so I dropped the college. Now I'm back into the school, but I'm studying on in-state tuition so no more F1 visa status for me. I'm working and paid 2013 taxes, my wife (current one) she started working recently too.

        So the Russian gal was not a U.S. citizen and could not Adjust or convert your status?

        So it seems that this is the first Adjustment of Status interview that you are qualified to complete. What is your country? Reason I ask is because USCIS reviewers use profiles of various country nationals to gauge potential problems.

          Yes Rayb, she couldn't convert my status, unless her political asylum case would be approved I would go just her husband and they would issue me a white card too, but it never happened. She didn't have her interview. And yes she wasn't a citizen of US. I'm from Tajikistan. Yes this is basically first AOS interview.

            Your home is right next door to Afghanistan. I've done a few petitions for Afghan nationals. Their paperwork is always a real hassle, because their documents are always "ad hoc," and probably give USCIS reviewers headaches: no real birth certs (just identity documents), no divorce records, etc.

            There is probably a 50% chance that you will be interviewed separately, but that is fairly predictable for such unusual relationships as your's. Make sure you each are prepared to answer questions about the other's family and background.

              Also we are right next door to China

              I have all my documentation, birth certificate, my passport (which is expired, can it be a problem?), my I20s from every school I have been in NY.

              We both work, so we didn't have that much time to prepare, I just hope they won't separate us.

              Can they do it right over there? Isn't it must be interview together at first try? Or they can separate is right on the spot? How usually this procedure is going?

                Many years ago I worked with Afghan refugees in New York and saw a few of one Afghan ethnic group that looked very Chinese (to me, a Westerner), and also blonde-haired Afghans who probably had some Russian blood in their genes.

                An expired passport is not a problem at an Adjustment interview.

                You have to expect to be separated for interview purposes, though it might not happen.

                The procedure varies depending on office and district rules, and what immigration history the applicants bring "to the table."

                  So here how is the interview went

                  So my interview went smooth, there was no problem in our papers and our answers, but at the end she found mistakes on affidavit of support (sponsor) she asked me if my sponsor has kids or wife - I said no, which he never told me and I never seen them - then there was some sort of business on his tax return that he didn't wrote what kind of business is it. And there was only 2012 tax form. Also he makes less than poverty guideline. She asked if I want to keep this sponsor and bring more support from him or change the sponsor. I asked her what she would suggest to do, she said that she can't advice anything - but in the end she said it's better if I bring the new one.

                  So after that she asked if we have any question, we asked "What's next?"

                  She said: I believe your marriage is bona fide and wasn't made to just obtain an residency status for money. She said she is approving my I485, but in order to receive card I must to bring her new sponsor document. She took my I-94 (but didn't write anything on a passport), she didn't ask me YES/NO questions. She gave me paper with this on it: "Adjudications 2 - Request for evidence" which says inside about tax forms of my new sponsor or old one. She told me to bring it to the 26 federal plaza or mail it till November 15th. (then i blacked out, i couldn't hear anything) just heard something like 60-90 days mailing, but don't know what she meant.


                  Anybody familiar with this Adjudications 2?

                    We had our interview in August 2014. My spouse & I were doing our interview separately. We did ask to provide additional document (my Baptismal Certificate) via a Request For Evidence. We received the letter via mail, and responded to it by providing the exact document as requested. Our lawyer told us that it is very important to provide specific document(s) as stated in the RFE. We sent back our reply via registered mail to USCIS the following day.

                    After a week, we received a notification that my AOS is approved, and the card is in production. Hope that your case would be approved, after replying to RFE.

                      Am filling form G-325A for my husband, i don't know what they mean by file number on the top right corner. Can somebody help please

                        The "file number" would be the "Alien Registration Number" on a K1 petition Notice of Action or other immigration-related documentation. If there is no "A" number available, leave that G-325A field blank.
