  • please help with I-130 and I864, few questions

hello everybody, I found this forum extremely helpful comparing to others. Although couldn't find any similar to mine questions. Hope that someone would be nice to help me here

So first question is - is it fine if I apply with my new last name even if my passport and joint bank accounts are on my maiden last name?

Part 13 of I-130. Has your relative ever been in the U.S.
Question - Its my initial trip here, we got married and now applying for AOS. So I've never been here before but now I'm here. What should I put in this part?

Part 22 of I-130 says if your relative is in USA and will apply for AOS at the USCIS office in what city and state.
Question is - what we should write here? City where we live or Chicago, IL (we are filing papers concurrently)?

Parts 13 of I-864 requesting tax return information for the last most recent three years. So my husband has filled tax returns for 2013 and 2012, and he hasn't done it for 2011 because of low income.
I assume that we DO NOT check the box of part 13 which states "I have filled a Federal tax return for each of the three most recent tax years..blah-blah-blah". And also we should fill income information only in 13a for 2013 and in 13b for 2012.
Is it correct?? Oh,and yes,we have to attach separate explanation of not filing 2011 tax return with supporting papers.

    I'd appreciate any help!!

    Thanks!!
    08/19/2013 - got married
11/08/2014 - sent out concurrent AOS package
    12/08/2014 - biometrics
01/24/2015 - got an invitation to initial interview (Feb.23)
    01/29/2015 - received EAD
02/23/2015 - interview, only I130 was approved, I485 on hold for review
    03/02/2015 - got an approval!

IF YOU WANT YOUR GREEN CARD IN YOUR MARRIED NAME, YOU NEED TO USE YOUR MARRIED NAME ON ALLYOUR PAPERWORK.

    ANSWER 'YES'

Part 22 of I-130 says if your relative is in USA and will apply for AOS at the USCIS office in what city and state.

    CHICAGO, IL.

Parts 13 of I-864 requesting tax return information for the last most recent three years. So my husband has filled tax returns for 2013 and 2012, and he hasn't done it for 2011 because of low income.

JUST LIST 2013 AND IGNORE THE TWO LINES.

I assume that we DO NOT check the box of part 13 which states "I have filled a Federal tax return for each of the three most recent tax years..blah-blah-blah". And also we should fill income information only in 13a for 2013 and in 13b for 2012.

LEAVE THAT BOX BLANK IF YOUR SPONSOR DID NOT SUBMIT A RETURN FOR 2011.

Is it correct?? Oh,and yes,we have to attach separate explanation of not filing 2011 tax return with supporting papers.

    I'd appreciate any help!!

    Thanks!!
