  • I-485, I-130, and I-864

We submitted a concurrent I-485 and I-130. We did not submit the I-864 as evidence for the I-485.

Will the submitted I-130 be used in place of the I-864 as an affadavit of support, and the I-130 petitioner will be liable for support, or does a separate I-864 need to be filed?

Does a I-485 ever get approved without the I-864?

We also concurrently applied for EAD (I-765)...will that get approved without the I-864?

Dog500, There's absolutely, no way u will get around, not submitting an affidavit of support, application. A request for evidence, will be sent to u, to submit same, within a certain time frame and if it's not received, therein, your application will be denied. U CANNOT get anything with an Affidavit of Support application, submission.

I left out the word.... without ALSO:- No one has ever been approved without submitting an I-864 application. My advice, after 3 years of her having her Green card, have het apply for her citizenship, to alleviate u of the stress of the I-864, u r feeling. Once she had this u r no longer obligated.

Can I be held liable based on the I-130 I filed?

If u do not submit the I-864, your case, will cease to go further. Your I-130, will not b approved. If u submit the I-864, u will b responsible for your spouse, until she becomes a citizen among other reasons. Read the instructions.. good luck
