  • Question about Assets for I-864

My husband and I just received a letter requesting more evidence for my I-485, specifically due to the fact they have said he does not earn enough for our household size (which is in itself confusing as according to all the criteria on the forms he does!) and so we need to declare assets.

Luckily, he owns our house with no mortgage and we now need to provide evidence of this.

My question is: Does anyone know (or has anyone done this) if we can send a copy of the recent Property Tax Bill which states the value of the house as evidence of its value?

The instructions for I-864 state that we need an 'appraised value'- is the value listed on the Property Tax Bill appraised?

We are going to send separate evidence that he is the registered owner and that there is no mortgage.

    Thank you

    Ms Bradley,

I would not recommend trying to use your estimated home equity to substitute asset value for an income deficit. Under normal review expectations, a very credible professional appraisal of "fast sale" value of the property, with clear evidence of the remaining mortgage, would be needed to use the home, and you might still have a problem with review of such evidence by USCIS (or NVC, whichever has your documents).

The fastest way of handling this sponsorship evidence problem would be a qualified co-sponsor.

Short of that, if you are certain your husband's income satisfies the income requirements, perhaps the evidence your provided or the forms you completed were not complete enough to satisfy a reviewer. There should have been a 2013 Federal tax return or transcript, W2 or 1099 copies, a recent employment verification letter or credible proof of self-employment. If the latter (self-employment), there should be proof of a legal business entity, copies of licenses, permits, invoices, and several months of bank statements.
