Hi there, Hoping for a few answers from you all to help my family decide on our next step in our immigration plight.
I married my wife back in 2010 when I was in the USA on a h2b working visa. I am a UK Citizen and my wife a US Citizen. After our marriage which was close to my visa expiration date we consulted with a Immigration lawyer and began to fill in forms 130- Petition for Alien relative, I-485 Adjustment of status, I-765 Affidavit of Support and I-693 Medical and Vaccination records.
Long story short we had a few financial hiccups during our application and ended up not filling our application which then meant I was living here without a valid visa (overstayed) It became a easier decision not to file for my visa through the worrying thought of it getting denied and all the other bills that seemed to be more important than us finishing my visa application at the time. Truly regret this decision.
I have never been arrested in my time here and have a clean record. I actually was a victim of a bank robbery in 2012 and had interviews with the FBI to help identify the culprits which I was amazed that they didn't ask me about my status as the time. I guess being the victim helped me in that situation.
Now we are in 2014. 4 years from when we first looked to start this visa process and now we would like to finally finish it. We have a child now and hope not to be separated. We also find ourselves in a tough situation because we are unable to move back to the UK together due to harsher immigration laws that they have put into force because of income requirements. To be away from my wife and daughter is something I hope to prevent.
We understand we have put ourselves in this situation and really just want to know if we have a chance to still fulfil our dreams of living in this country and myself legally before we put up the money for a lawyer and the filling fees..
Any help/thoughts with this would be greatly appreciated
