  • B2 visa planning to marry before i-94 expires

Hi I came in the US last June 2014, I am planning to marry my boyfriend this coming Nov 2014. He is a US citizen. We only met here through my sister's friend. Now, we wanted to get marry here and have a family. Is it possible that i can adjust my status? Or should i go home cos my I-94 will be expiring soon specifically Dec 2014 and go back after 3-4 months? Thank you for someone who will reply. Please.

    B2 getting married

Yes, you can get married and then adjust your status while still in the states. If you choose to return home then file you would have to wait until the process is complete before coming back. For example, if you try to come back on your B2 after you are married you probably wouldn't be allowed in as a tourist because it would be expected that you would be staying.
This is my opinion not legal advice.

thank you for your reply. So do you think its way better to stay and file than going home to avoid delay? i am also thinking of getting a lawyer but its really expensive. are you also in the same boat as with me? thank you for your time

Yes, I think it would be faster to stay and file from in the U.S. I don't think you need a lawyer though. You just need to complete the forms and submit the payment. Once you have completed the forms you should have someone look over them to make sure they are completed correctly but you are correct that a lawyer would be an expensive option.

          Sam

Have you been applying the same thing as with me before? Thank you for replying. What if we have just met recently and we still don't have those requirements like joint account, a lease that was name after us. Is it important to pass only the marriage cert and wedding pictures as evidence and photos dating?
