    Hello -

    I have a complicated and weird situation. I am a US citizen. My spouse moved in with me, and in doing so, allowed an F-1 visa to go out of status. We married a couple of months later, and were planning to file a change of status. Unfortunately, it was decided that our marriage was not working (we were only married for a few months). Now, there is the question of still filing the paperwork. My spouse wants me to do it, but I will not lie at an interview - I would say that our marriage didn't work.

    I feel bad about the situation, but in the end, we have only been married such a short time. I don't want my spouse to be deported, but at the same time, our relationship is over. I don't want to spend the filing fees if they're not going to approve it.

    Questions:

    1. Is there any way that this can be salvaged for my spouse if we are broken up after such a short time (in terms of filing change of status)?
    2. Without going back to the country of origin, is there any way my spouse can renew the F-1 visa (only been out of status for this semester thus far)?

    Hi sorry about your relation you can still file the the paperwork and have your wife pay for the fee she or he still can get status in usa but you mast not Lie to uscis you can say that we got Married with a good attention but thinks did not work out but if you are all ready divorced and you have not fail any think with uscis you cant help here or him good luck

      We have not yet divorced, and it will likely be a while before we do, but we live in separate places and are transitioning out of joint finances. I've tried to reconcile, but my requests have been declined.

      Would we still "pass" the interview if I agreed to do it? Of course, I would be honest and say that we are separated, but we have only been married a few months. I'm not sure the interviewer would believe it.

      Would it just be easier for my spouse to try to get back status by F-1 Visa (that is out of status as of now) - or would that require a trip back to their home country?

      Please advise. Thanks.

          No, not yet. My spouse still wants me to do the paperwork though because we are still married. Since we split up after a short time of being married (less than 3 months), I'm thinking it won't get approved. Would it?

            If you want to help here or him you can file the pepper work she will be able to stay in usa even know that you are getting divorce because you have enter the married with a good faith after you file the paperwork you can informe the immigration that you are getting divorce you dont even have to go to the interview your spose can still get get the permit residence here all she has to say That The marriage was in a good faith and emigration well I'll prove her
