    Hi,

    I am currently in U.S. in H1B and my spouse and kids are also with me as dependents. My brother had filed immigration petition for me and my family. The case has been approved and it has been forwarded to National Visa Center. My priority date is September 2010. I am wondering if I am eligible to apply for AOS and if so, how long will it take to get green card.

    Responses are greatly appreciated!

    If your case was put in 2010, then you may have anther 6 or so year to wait. U will be notified when your propriety date becomes available.

      Depending on your country of origin, sibling petitions that are current (eligible for visas) must have Priority Dates from 1991 to 2002. Your class is F4 and the Priority Dates currently available can be seen at: http://travel.state.gov/contenthttps...ober-2014.html

      You have 8 to 19 years to wait, depending on your country and updating of current Priority Dates on a regular basis.
