Hello

We someone overstays their visa and then applies for a green card ( married to US citizen ) do they pay a penalty for overstaying ?

When applying for Adjustment of Status (conversion of visa to Green Card status), there is no overstay penalty if all other evidence is present (proof of legal entry to U.S., proof of U.S. citizenship of your spouse, etc.).
