I'm about to be in a very complicated situation and I could really use some guidance, so all and any help is warmly welcomed.
I entered the USA in January 2010 using the VWP, to visit my current wife which wasn't the intention to begin with, I was just excited to visit America! The friendship clearly led to something more, by April 2010 we got married and filed my EAD, I-130, and my I-485 everything from this point had been smooth. We had our very first interview that same year the immigration officer spoke to us and everything in his eyes was fine, but he wanted more proof of the marriage for my records so we said we'd be able to provide that proof without any issues. The officer told us to wait for a letter asking this information and proceed accordingly, so we did.
This is where my journey starts going down the pan, the letter never got to us it was returned back to the immigration office which they still have now, in result to this my I-130 was denied. On On May 7, 2012 they received my I-290b which is to appeal the unfair denial of my I-130. And from this date I've been waiting with no updates, nothing....
I have been married now since April 2010 and now my marriage has taken a huge strain and is now came to and end, but divorce proceedings have not taken place as of yet.
Is there anything I can do so I don't have to leave my current life in the US or do I need to remove myself from the country as soon as the divorce is final?
