    Hi and hello,

    maybe someone here can help us....hopefully!

    My mother lived in the US for 10 years, I was also born during her time in the US, so, I am a US citizen. We then went to Europe because of personal reasons.

    I am in College in Austria now,. my mother is in the US to visit and I would now like to sponser her, so that she can remain in the US - since I also want to return home in 1,5 years to get my masters in the US and then stay and work and live there.

    My mothers GC expired back in 2002 - before then she did contact the US Embassy and was told there is nothing she can do about it - the GC is GONE - she was told back then! Which is not true - at the time it was under 5 yrs and we DID have options! But she trusted the statement and so we stayed in Europe - until now.

    Can I - living and studying abroad at the time - sponsor my mother in the US? She is now trying to get AOS also. She is there as a visitor right now.

    I understand I would have to have a domicil in the US - my father and rest of the familiy lives there, he also has to pay two more years of college for me and has a life insurance in my name, ordered be the court when my parents got divorced, does that count anything? Ihave no house or bills in the US at this time?

    I would love for my mother to stay in the US - she could get a good job right away and it would make it a lot easier for me when i get over there to finish my studies?

    The requirements for petitioning and sponsoring an immediate relative specifically expect the petitioner and primary sponsor to have a domicile i the U.S., and will be expected to be present at the Adjustment of Status interview.

      The interview would not be a problem, I can fly to the US for that. The domicil would be since I am in College in Europe - so the answer would be NO? :-(

        If you are a student abroad, it would be expected that you have a base addess in the U.S., which would be considered your domicile.
