  • Form I-864 items 13.a.1 and Form I-864A, line 11

We received a checklist saying that the applicant meets the minimum qualifications for a visa interview. Yet the AOS contained the following 2 errors and needs to be redone and sent directly to the applicant for the upcoming interview (have not received the appointment yet).

Error 1: Form I-864: In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

My dad is the principal petitioner, sponsoring his sister. He filed a joint tax return with my mom. Since my dad has retired, all the income on their Form 1040 is from my mom. We used the TOTAL INCOME on line 22, Form 1040 to put on the line 13.a.1. Therefore, line 13.a.1 should be accurate. Or should the line 13.a.1 only be reported as my dad's portion of the total income, which is $0?

Error 2: Form I-864A: Part 1 Information on the Household Member
[x] XYZ's income indicated on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s).

The I-864A was filed by my mom. The line 11 is reported with the same TOTAL INCOME on line 22, Form 1040. It should be accurate because all the income is from my mom.

We do not understand these errors because we believe we have provided the accurate information. Would any one please advice? Thank you!
