if i file i-130 first, do i need the i-864 concurrently?

  • if i file i-130 first, do i need the i-864 concurrently?

    Hi i am filing my i-130 this coming saturday. if anyone could find whats missing in my forms would be welcome. Thank you so much..

    Dear USCIS Examiner:
    Enclosed please find my I-130 Application also my G325a and supporting documents. Please also find the money order for $420 to cover the fees.
    *Money Order amounting $420
    *Form I-130: Petition for Alien Relative (my wife)
    *Copy of my Naturalization
    *Copy of my US Passport
    *Copy of my SSN
    *Copy of my Marriage License, our Marriage certificate would be available after 6weeks so I just sent this copy as one of our documents of our wedding.
    *G-325A filled out by myself.
    *One passport-type photo of myself with my name written on the back.
    *G-325A filled out by my wife Woinee Marcelo Peter.
    *One Passport type photo of my wife with her name on the back.
    *Copy of her I-94
    *Copy of her Philippine Passport
    *Copy of Birth Certificate

    Some evidence of a bonafide marriage which includes the following:
    A Wedding picture of me and my wife before the wedding, during the wedding and after the wedding.
    A sworn affidavit of one of our witness in our wedding

    hello, I haven't got our I130 approved yet but this list is what I have gathered from different sources and worked truly hard on it even though I suggest you to go to the other websites and gather as much info as you can. Anyway wish you good luck and fast approval!!

    Ok so this is our list and yours may be different, and as an evidence of bona fide marriage you should provide joint ownership or leasing, any kinds of big purchases as car, house appliances, travel tickets, etc., under both names, any other documents that show owning or purchasing together any accounts, cards, phone contracts and other expensive stuff.. We didn't have such things, so we couldn't provide it. And if you have kids it'd be copies of birth certificates ))
    08/19/2013 - got married
    11/08/2014 - sent out concurrent AOS package
    12/08/2014 - biometrics
    01/24/2015 - got an invitation to initial interview (Feb.23)
    01/29/2015 - received EAD
    02/23/2015 - interview, only I130 was approved, I485 on hold for review
    03/02/2015 - got an approval!

      hey nee21, see highlighted comments in your text. Please take it is an advise not an instruction I just put what I learned from this and other sources you may need to revise your papers with an attorney if you don't have time to research all information by yourself ...

I'd suggest you to wait until you get the actual certificate! It's better wait and get all your papers done properly than get denied because of lack of evidence!         ---THANK YOU for your help. Wow, i am praying for the fast approval of your I-130. I am currently on process for the papers. I am in hurry cos my visa is expiring this dec 17, i assume applying for the I-130 would put me to the "protected mode". I would want to be legally stain here. The marriage license is the only evidence we have now, there's a date place and registration number of the marriage. We still don't have the joint account since we were married for like 3weeks only..

          Well, one of the first things I have learnt is overstay is forgiven for spouses of US citizens. Especially in your case it;s obvious that you have to wait till you get the certificate to apply for AOS and your overstay is gonna be just couple months!

          Second, don't be hurry with this kind of situation when you don't have a lot of money. Remember that a mistake or lack of supporting documents would lead you to re-applying what means another payment or hiring an attorney.

          What is your type of visa and how long was time between your arrival and marriage? I also know that You should not get married too fast after arriving here. Otherwise it might be considered as misrepresentation of non-immigrant visa application purposes...

          Overall I don't want to scare you or anything just BE prepared thoroughly and DO NOT BE in hurry If your marriage is legit and you show that you are in good faith relationship, and you send out properly and fully filled papers, hopefully everything will be just fine!

            --- I was on a b2-visa (tourist) I came here last June 2014 and had a ticket of returning home last July 17 but then, i met this guy (my sister's co-worker and her boyfriend's friend) he was a teppan chef in my sister's work, we started hanging out and all that stuff and then we became bf-gf after 3weeks. He proposed to me last september and get married Nov 29. I really don't plan staying/marrying here when i came here cos i have a good job, i have my car, still living with my parents (which i don't have that expenses that much) meaning i am really living a good life. Anyway, well i fell in love and risk everything because of that.

            --- Did you hire an attorney? What is your visa when you came here?

              your story is almost same as mine but I came as a student F1 visa

              No problem, I understand all this frustration with immigration process and I understand how you feel risking everything ))

              It seems that the time gap is fine between arrival and marriage so don't worry about that part cuz you have developed a relationship within few months.

              I wanted to hire an attorney but did not because they charge at least $1500 for just doing paperwork what you can do by yourself just fine... Besides our case does not include any big complications such some people do like criminal history, previous marriages with AOSes, or low income issue, etc., so we just put our own effort and time, and filled all papers out using internet ))

                --- I am planning to file first the i-130 cos i can be able to pay the 420 and we can't be able to pay the additional 1070 for the i-485 cos we still don't have that much cos we are just starting and I am unemployed. What visa are you in? Thanks for sharing your experience with me

                  My visa is F1 student but I'm not studying now.

                  So I've called several attorneys just to get their pricing and briefly discuss our case. They asked if my husband's got required income papers for the last year and if he meets the requirements of income level. If not we'd need a sponsor. Nobody cared for my overstay which is almost a year now.

                  And yes we did file concurrently to get it over with as soon as we can.

                    ----I don't know if i am going to file first the I-130 before my visa expires or file it concurrently with my I-485 as soon as i ave the money with me. I do have the money for the I-130 but since i still don't have my marriage certificate with me I'm scared i might get the RFE.
                    ----I am hoping we could get the 'legal' status here. I'll be praying for our papers

                        If you are submitting only an I-130, do not include the I-864 with it. You do realize that your sister will have to wait at least 12 years for a current Prority Date?

                        The I-864, with supporting sponsorship documents, is submitted only as follows

                        1. To the National Visa Center if sister is being processed abroad; or
                        2 With the I-485 if sister has a current Priority Date and is being processed Stateside.

                          hi. thank you for the details it was huge help. but i still dont know whether to file i-864 concurrently or not? because my husband is able to file it along with all the other documents so shall we wait after i-130 is approved or IS IT ALRIGHT THAT he submit i-130 to USCIS and i-1-864 to NVC concurrently?

                            hi. thank you for the details it was huge help. but i still dont know whether to file i-864 concurrently or not? because my husband is able to file it along with all the other documents so shall we wait after i-130 is approved or shall he submit it along with all of the above mentioned items in your list?
