Filed i485 for my son, still no acceptance, only 15 days left of lawful presence
Hi everybody.
I married a US citizen last year (2013), and became permanent resident on January (2014). My son entered the United States in June 28 with a B2 visa. My wife filed an i130 in October, and filed i485 one week ago, but still no notice of acceptance of the form, and my son's i94 voids on December 27, that means he have barely 15 days left of lawful presence. My son will become an unlawful alien if the they reject the i485? They give me some days to file again the i485 if some change is needed? Is advised to ask for an extension of his B2 visa meanwhile I receive the notice?
Any help in this sense is appreciated. Thanks.
