Hi - to get started, my father, my mother, my sister and I applied for green card as EB-3 back in 2002 under my father's name.
In 2006, we were notified that our I-485 was pending and we waited - but no news came. After years of frustration from no replies, we applied for green card under my mom's name, this time as EB-2 in 2011. Everything was smooth sailing - we did our finger print scans in February of 2013, and we were to expect our I-140 around at July-August of 2013 at the latest. However, nothing came.
When we opened up our EB-2 application, our lawyer decided to also work on my dad's EB-3 case simultaneously - Using my father's application, our lawyer tried to get our family's EAD's all renewed (this was in 2012) - first my father got his EAD renewed, but everyone else in our family was denied, which we sent an appeal that was approved - and the rest of our family got our EAD's approved as well. Now the twist - when we tried to renew our EAD again in 2013, all of us EXCEPT my father got our EAD's renewed. Wondering why this was the case, we sent in a letter from the congressman asking for the exact status of my dad's application - and it turned out that the I-485 just for my dad's Alien Number was set to administrative closing. The fact that it became administrative closing didn't make sense as we were able to get our EAD's renewed just a year ago...We sent in an i-209B (MTR) about a year ago and haven't heard back since. We have sent in 2 inquiries about this recently but there has been no reply to it as well.
Now, the question we have is - is it possible that our I-140 under our EB-2 application isn't coming out because of the complications in the EB-3 application? Where should we go from here? Any help or advice would be greatly appreciated.
