EB3 - India - I-140 approved (Vermont Service Center) - Can we apply for I485?

Hi all,

One of my friends has his I-140 approved from Vermont and he is EB3 from India. His lawyer and employer are telling him that there is a priority date to meet and he can't apply for I-485 now. Is it so. Please clarify.

The lawyer is right. EB3 for India is current at 01 Dec 2003. So if Your friend applied PERM on or before this date the I485 can be filed.
