Success DV Lottery but (only) my wife left U.S. during application in process
Hello!! and many thanks for your help in advance for anyone wants to help me with my case. What happened is:
I have been selected for further processing in the DV 2015 program. So, I:
1. Filed everything for myself, my son and my wife on Oct 1, 2014 (we are all under E1 VISA valid until 2018)
2. We have been all finger printed by mid Nov (fast)
3. Interview scheduled for all by end of November (super fast).
The problem is that my wife (i didn't read carefully the instructions) left the country before the interview (while the application was in process) so only I and my son have been regularly interviewed. I didn't submitted the I-131 Parole for anyone of us. My wife's application is going to be denied for abandonment. The question now is how to move forward:
a) technically my son and myself are ok (we didn't left the country). Are we going to receive the Green Card regardless of my wife's case or all cases are linked together? Are our cases to be hold due to my wife's one? I was told that ours are going ahead separately in any case by USCIS. What happen to her case?
b) Can I refile the application for her paying another fee and submitting all documents now, or shall I need to wait the official denial letter first? Does someone know how long it's required to receive it?
c) The local USCIS office told me several times of being about to send me the denial letter, but til today I didn't receive anything in the mail.
I'm afraid that since one application is pending I cannot file another one, is everyone who lived the same situation or helped somebody else in the same situation who can help me?
