  • Question about Affidavit of support

Hi everyone! I have been preparing papers for weeks and I am having trouble getting the 2014 taxes done before I file my concurrent I-130 + I-485 papers for a marriage based green card. They told me I need a W7 form and an ITIN number so my husband can file taxes including me. My question is: Can I file my papers just including transcripts of the three previous years without 2013 W2 or would it look better to do all taxes paperwork and file 2014 taxes before sending my papers?
I would have to wait two more weeks to do 2014 taxes paperwork and that means to not have a EAD two more extra weeks= less money in the house.

If you have an IRS transcript for 2013, you don't need a W2 as the IRS transcript is an authenticated record of the W2 being submitted with your tax return.

It is still early enough that you can get by without using a 2014 tax return (or transacript), but it may be requested later or at your interview.

      I appreciate your fast answer

Your answer has been very helpful. I will file the papers ASAP and while I wait for my interview, I will go ahead and do all tax paperwork for 2014.

        Affidavit of Support

We sent the I-485 and the I-130 by itself. We did that on purpose as at the time I needed documentation from my employer of a raise and when we were sending the application I had not received it yet. If you look at the USCIS website it does not initially ask for the Affidavit of Support. You will need to provide one eventually but to start the process and apply they don't ask for it. Two weeks after they received the application they asked for the financial support paperwork and by that time I had the documents I needed. I did not provide the W2, only the copy of the tax returns I filed as your tax return is based on the W2 your employer provides. I also included pay stubs. No other financial documentation was required.
