  • Petition approved, and what should i do?

    Hi all members,

    August 2014 : apply for petition I-130 (at that time my husband still GC holder)
    December 2014 : Husband got his US Citizenship
    January 2015 : my petition approved (and on the letter said my case send to NVC)

    What should i do?
    Cause i read some information that i need to wait NVC send me a letter (wait for my case number), then i need to send a letter to upgrade a petition become immediate relative, a copy of approval petition letter, and a copy of citizenship certificate.
    Its that right?

    After that, do i just send my I-485 form and other supporting document? Or i need to wait a reply from NVC first?

    And i have 2 more question :
    1. Part 3 point A (form I-485) about : were you inspected by a U.S. Immigration officer? What should i answer yes or no? I'm entered US legally.

    2. I pay $1070 for Form I-485, is that include form I-765 and I-131?

      NVC response to approved petitions is average 6 or more weeks. Have you tried calling or emailing the NVC?

        Hi RayB,

        I hvnt called or email the NVC, what should i ask?
        I will call tomorrow.

        Btw, i have a question :
        1) form I-485 part 3 point A about "were you inspected by US immigration officer?" What should i answer? Yes or no. Im enterred US legally.
        2) do i need to submit form G-325A for my husband too with form I-485?

          You do not send an I-485 to the NVC. If applicant is outside the U.S., you will be sending sponsorship and civil documents to the NVC.

          If applicant is in the U.S., you will be sending i-130, I-485 and i-864 (and other supporting docs) to USCIS.

          1: Yes
          2: I-485 needs only G-325A for applicant, not petitioner. The I-130 needs G-325A's for petitioner and applicant.

            Yes Rayb, im not send an I-485 to the NVC.
            My petition is approved (on the approval letter said my case send to The NVC), now my husband is Citizen so i need send a letter to upgrade my petition to immediate relative, but i must wait for the "Case Number" from The NVC first right?
            You said that the NVC will response approval petition for 6 or more weeks.
            Should i call the NVC to ask if they already receipt my approve petition from USCIS?


            If i already get the "Case Number" from the NVC, and send them a letter to upgrade my petition, Can i submit my form I-485 with another supporting document to USCIS right away? Or do i need to wait a reply from the NVC first?
