  • Running Red light

    Hi Ray B
Just this afternoon I just run the red light and the officer pull me over, and he gave me a ticket to appear in court next friday.
However am about to send my application in for adjustment of status . although I have over stayed my status and he ask me to come to court with my passport and visa page.
I need your advice on this pls.
    Thanks.

What is your visa type and how long is your overstay?

My initial advice would be to show up with your passport and visa page. I doubt that you will detained as a visa overstay for this type of traffic violation, but it really depends on local law enforcement policy, so a second opinion is advisable.

B2 and I came in Nov 2013 with a 6 month stamped at the port of entry till may 2014.
Even though the visa expired by February 2014.
So am completely out of it.

halarks...I didn't think traffic court cared for your visa status. Why did you tell the cop you were a foreign citizen? or your visa ran out?....it's not their business...i.e cops are not immigration officers and most of them have NO CLUE regarding the various visas that are out there etc.

While you can take your passport & visa page, don't volunteer to give it to the court judge, as it's not his business...i.e he's not qualified in immigration law.

Don't worry too much....you'll be fine. Traffic court in most cases is a joke. Try and be respectful to the judge and ask him if he could reduce the fine...and put your case upfront and tell him why you ran the red light by mistake??...i.e if it was green when you saw it from far, was yellow and you couldn't brake in time etc...whatever the reason is, concentrate on that...

        My 2 cents.

          Thanks so much Ray B
I went to the court house today, the judge didn't ask for the passports the cops ask me to bring, she just ask me for my international driving license and the insurance and immediately she discharged the case of not having a valid license and ask me to pay a certain amount by march 13th.
Thanks so much Ray B for your info.
