  • sponsor's unemployment by the interview date

    Hi everyone!
I need an opinion on following matter - my husband is my sponsor on I864, and he's willing to quit his job soon. I'm asking him to wait till we pass the interview which is upcoming in February because I'm afraid that USCIS would probably look at it like he can't provide me or we will have to find an additional sponsor... Well, my concern is also that he has changed jobs several times last year and he's not happy with the current job either, and an immigration officer can make a big deal about it.. My husband thinks that it shouldn't be a problem as long as his annual income on papers meets the required amount...

So I need another opinion, fellas please help us to make a decision! Thanks!
    08/19/2013 - got married
11/08/2014 - sent out concurrent AOS package
    12/08/2014 - biometrics
01/24/2015 - got an invitation to initial interview (Feb.23)
    01/29/2015 - received EAD
02/23/2015 - interview, only I130 was approved, I485 on hold for review
    03/02/2015 - got an approval!

Your husband is wrong about his assumption that his stated annual income will meet the sponsorship requirements. Proof of ability to maintain his income is a critical piece of the sponsorship requirement. If your husband admits that he is not currently working or is asked directly about his employment status, his truthful answer will result in a request for more evidence before your Adjustment of Status will be approved.

While it is not likely that the interviewer will send anyone to the phone to check your husband's employment claim from his I-864 and attachments, lying to the officer can escalate your problems.
