  • Green card paperwork for spouse in a different state

    Hello all,

My husband is a US Citizen and I am currently on H1B. We got married in Jan 2015 Minneapolis where he lives. After getting married I stayed with him for a week. After that I had to go back to work in Texas because of prior commitments.
I am going to quit my job and move to Minneapolis in 2 months.

    We are filing 130, 485, 765 and 131 concurrently.

I want to know if I should show his address in Minneapolis or my address in Texas on form 485, 765 and 131.

    Help will be greatly appreciate.

Showing a different address than that of your husband is a red flat for the reviewers to request further proof of the legitimacy of your claimed marital relationship.

Thanks for the quick response Ray.

I have work commitment till March end. Hence, I could not move right after.
Besides proofs like marriage photos etc. We are showing our joint bank account, joint phone account, travel itineraries showing that we meet every 2 weeks.

And as I had mentioned earlier, I will be moving in with him in April. And that will be way before our interview gets scheduled.

Your proof of a work requirement at a different location from your husband, as well as proof that you will be back with him in April, should be adequate evidence to explain why you lived apart so soon after your marriage.

But you can probably expect the reviewer to discuss this to satisfy himself of the legitimacy of your claim of an ongoing martial relationship.

I also had one more question.

I want to know if all the forms should be mailed in one package.
Or should my husband send 130 package to Chicago Lockbox and I send the rest to Phoenix Lockbox because I reside in Texas?

Everything should be sent in the same envelope, at one time, to the Chicago office.
