Tourist Vista - Petition I-130 - I-485

Hi everyone,

I want to file a i-130 for my married son over 21. He and his family all have tourist visas to come to the US - they are good for 10 years. I have learned that since he is married he falls into the "third preference" category and hence they would face longer wait times. My questions is the following: Can I file the I-130 and in Parallel can my son and his family come to the US with their tourist visa - Once they I arrive to the US can I file the I-485?

If I can file the I-485 would their wait time be shorter?

Darwin,

You can file an I-130 for your son, but an I-485 would not be accepted because your son would be placed on a "visa quota" waiting mode, taking several years (depending on his country of origin).
