  • Should I do Concurrent Filing if I overstayed on my B2 Visa?

    My wife, a US Citizen, and I just got married but I have been here for 5 years, and my B2 expired on 2011.
    Should we do Concurrent Filing ( I-130 and I-485) together? or would it be too risky?

    ---- hey there, if you came in to the country legally there is no risks at all to adjust your status.
    you must send a copy or your I-94 with you applications and you must bring the original one you received at time of entry to your interview!
    my wife I s currently in process, she came in with a visa when she was 12 yrs old and her parents decided to stay, that was like 10 years ago!
