  • I-864 questions about my situation.

    Hi everyone on immihelp,

I'm on the process of preparing my packages for AOS. I have a question that need your helps because I'm a little bit confused about it. Here is my situation:

I (F1 student since 2010) and my wife (23yrs old - USC) get married on Sept 2014 and we're preparing the application now. I think our case is simple because we have the documents (proofs, bank statements, phone accounts, tax documents, co-sponsor, ...) we need to submit to USCIS. However, when it comes to the I-864, I'm a confused and don't know how to fill in part 6 of this form. It's because my wife is a dependant to her parents during the last three tax years. Until now, she's still in nursing school and probably still has no income until she graduates in Spring 2016. I have my cousin who is willing to be a co-sponsor for my case and his income is well above the required income of USCIS.

How do I fill in part 6 of the I-864 form if my wife is a dependant during the last three tax years? Do I need to submit her parents tax transcript to show her status as a dependant in the last three years?

Thank you very much for reading my question. If you want to know any more information, please feel free to ask.
Hope to receive your response soon.
    Any help is greatly appreciated

If your wife did not work, then she should put zero but she must, on an independent sheet of paper, explain why she didn't file taxes.

Hey there, just want to add.
Make sure your cousin co-sponsor has a green card or is a citizen with other type of legal document he cannot sponsor you.

      Just a double checking

        Dear MaryH,

The reason, of course, is she had to attend school and had no part-time jobs during the time she attending school.

Does the paper need to be notarized?

        Thank you for your response

        Hi JPALMA123,

Thank you for your caring. My cousin is also an USC, so that should work.

        Thank you very much
