    Good day members!

    I am writing this post to seek some answers or personal advice and also as a reference for other future members who may fall in the same situation that I am.

    We are currently filling-up forms and gathering evidences for my petition and we stumble into a roadblock that I think that you will be able to guide us. There are some clarification in I-864 Affidavit of Support that you maybe able to enlighten us.

    Me and my wife was married on 2012. She start working as an Individual Contractor (Self-Employed) in 2013 up to the present. We filed a tax return for 2013 and we haven't file our tax return for 2014 because she is still waiting for her 1099-R but we have already paid our quarterly tax schedule. Also, based on the adjusted income, my wife taxable income is above the fed poverty guidelines.

    Our roadblocks are:

    1. In I-864, Part 6. It asks for 3 consecutive filing years - at the moment we can only fill-up the Income year for 2013. Will this scenario creates a problem during the review process of my adjustment of status?

    2. In I-864, Part 7. Assets - I read somewhere (please correct me if I am wrong) that you only need to fill up this part if your adjusted taxable income is below the federal poverty guideline. Since we only have one Income Year in Part 6, Is overloading an asset information creates a positive or negative perception?

    3. With my current situation, would it be better if I just get a joint sponsor?

    Again, thanks to all the members who continuously support, provide personal advice and shares their personal experiences.

    Providing total income amount (line 22 of Form 1040) for 2013 alone, along with an explanation for why the 2014 has not yet been filed, will meet the sponsorship requirements, if other proof of current income will annualize to meet or exceed the sponsorship requirements.

    If income proof is low, then include liquid asset information if such assets can be converted in short period of time and are at least 3 times the income deficit.

    If still in doubt that your I-864 information will not meet the sponsorship requirements, then bring in a co-sponsor.
