    Hi rayb,

    I have a joint sponsor for my I-864 and he has just filled a 2014 tax return. In my knowledge, he will have to use his 2014 tax return for I-864 form since it requires the most recent tax return. However, there is a problem and I don't know is it ok to submit his 2014 tax return. The problem is he has filled a tax return for the 2014 year but hasn't paid any taxes yet. He is now travelling out of the country for about 2 months and he tell me he will pay his taxes when he return. Is it possible for me to use his 2014 tax return for I-864 form (as the most recent tax year)? Will it be a problem with USCIS because my sponsor hasn't paid the taxes for 2014 year yet? I don't really want to wait until after he comes back and pays his tax because that will delay my application a significant amount of time

    Please enlighten me on this problem

    If the tax return has been filed, you can use a copy of it, with other supporting docs (I-864, W2's, proof of US. status) for co-sponsor purpose.

      Hi rayb,

      I've just receive my sponsor's income tax return copy for 2014. His income in three consecutive years are

      2014: 22k
      2013: 23k
      2012: 15k

      Do you think i should submit 2013 and 2012 tax return copy. Although the income is well above the cut off mark for 2 people household, i feel a little bit worry becaus this year income is less than 2013. He is a self-employed truck driver and his Schedule B of gross income is about 175k+ for each year. Please give me your suggestion about what tax year should i submit?

        In either case for 2014 and 2013 you would be above the requirement. All they ask if you want to get technical is that you MEET or EXCEED the required income level for your household size. It is stated on the website, so if you meet or exceed the household income then there should be no worries. If it makes you feel better then send the his W2 and tax returns for both 2013 and 2014. The W-2 is easy to read and states exactly how much you earned without having to comb through your adjusted gross income and all the other crap. Send in some paystubs too to show that he is currently employed.

            Use his latest (2014) tax return with an explanation for the next being so close to the sponsorship threshold. Self-employed sponsors can provide proof that "income available" is much greater than the net shown on the Form 1040.

              Sorry Ray B but I do not really understand about the explanation. Please forgive me if my questions bother you. I'm not a native speaker so I may misunderstand you .

              What does he need to explain to USCIS about his income ?

              As I stated in my previous post, in his Schedule C (Profit or Loss from Business), he is showing a gross income about 175k+ in 2013 and 2014.
              What my concern is do you think it's necessary to submit 2012 tax copy (the lowest income year)? Can I send only 2014 and 2013?

              Please enlighten me on this issue

                I'm sorry, but my explanation was somewhat scattered with a mistype in the middle. Let me try again below.

                It will be okay to submit copies of his three Federal tax returns, 2012, 2013 and 2014, including 2014 1099-MISC forms (if he received them).

                A separate attachment might be useful for him to draw attention to his much larger amount of gross income in the "self-employment" Schedule C in his tax return, to illustrate that he has significantly more income available to him, but much of it is expensed off with bookkeeping expenses (depreciation, etc.).
