I had filed I-130 Petition for my Spouse when I was a Permanent Residence, but we sent a letter and copy of Naturalization to California Service Center to Upgrade my spouse Petition form F2A to Immediate Relative after I became US Citizen. But USCIS send back our letter writing Thank you for your Inquiry. when I received approved I-130 petition, under section it says Husband or Wife of Permanent Residence instead of Spouse of US Citizen. Now I have sent letter to NVC to upgrade petition but has not heard anything for about two weeks. How long does NVC take to upgrade the Petition and will I get new Approved I-130 writing Spouse of US Citizen instead of saying Spouse of LPR?
Now should I had waited for Upgrade from NVC before I filed I-485? Also On approved I-130, it says since your beneficiary is in the US, you need to contact your local office to get form I-485. Why can't I print form I-485 myself and submit to USCIS IN CHICAGO? Do I really need to go to USCIS to get form I-485? Also, I have already sent I-485, approved I-130 (the one I have right now) and the required documents along with the copy of Naturalization, thinking my spouse is a citizen and I don't have to wait for Priority date, will they process the From I-485 or they will return back saying your priority date is not current?
Though, looks like they are processing my form I-485 because I received a email from USCIS, Saying fingerprint fees for Form I-485, form I-765 and Form I-131 has been received. Now I am waiting for Paper Notice of Action I-797 to know the details. I just wanted to make sure what I did was right and I do not have to worry about anything.
Please let me know what would you do if you were in this situation and I would really appreciate if Someone can answers my Questions above.
