flying domestically in US with expired i-94, i-485 app pending, interview scheduled

  • flying domestically in US with expired i-94, i-485 app pending, interview scheduled

    is it safe to take a flight with a valid foreign passport but an expired visa? our i-485 case is in process, our interview is scheduled in a few weeks but need to take a flight before then if possible.

    Normally, nobody checks your visa and passport information when travelling domestically.

      Her passport is the only Id she has so she will have to show that although her visa is on another page. If they do happen to see her expired visa could it be a problem? What if she brings copy NOA for her 485 and a copy of our marriage certificate?

        Bringing those other documents (I-485 receipt and marriage cert) will help her if she is detained at an immigration check point at some Texas and New Mexico locations (or anywhere else if challenged by ICE or BP officers). But showing the passport as ID when boarding a plane is not likely to cause a review of her visa status. Domestic airline employees have no interest in visa status.

          Thanks. And if she is detained what could happen then? Just some questions and delay until they verify she has an interview for AOS scheduled in a couple weeks? Or could they deport her or something else?

            Proof of an existing Adjustment of Status procedure based on marriage to a U.S.citizen will normally satisfy any immigration check point challenge that your wife is in a "protected mode," from any adverse immigration adjudication.

              Thank you. Is a copy of 797 OK? Or is original necessary? We don't want to bring original because we have to bring it to the interview

                "Country / Region of residence Passenger" while flying domestic

                Hi,

                I am planning to fly domestic (within USA).

                I have valid Indian passport with valid L1 visa.
                I do not have any Id proof by US govt (State Id or Driving license etc..)

                In American Airlines reservation form there is a section "Country / Region of residence Passenger" .

                Which country should I fill in this field : India or USA ?

                Please suggest

                  You can go with your passport.
                  The only thing they gonna check is the Bio Page
                  Do not worry.
                  I dont remember asking me for residence country for domestic flight.

                    Although its not asked but I assume (based on your reply) that it's totally ok if I fill "India" as 'Country/Region of residence'
