    I am in dire need of advice. Today my wife J visa received an RFE for our i864.

    They are asking for proof of income for me and her. Now, i made a mistake and didn't submit my tax return or paystubs, which i can handle easily.
    However, my wife has been working at a gas station under the table for 2 years; illegally.
    Which I stupidly thought would be a good idea at the time(honesty is the best policy?).
    Well, now they are asking for her paystubs as well, and an employment letter.
    Her boss absolutely refuses to give any sort of letter as he doesn't want to get in trouble.

    Question. Am i able to just submit my paystubs as a proof of income and just explain the situation to the uscis in some form of handwritten letter that she has no paystubs because of my situation? I can provide proof of all of my bank statements, employment letter for myself easily, but I just don't know what to do. I could even get a cosponsor if they really need it. I'm lost guys. What do you think? Thanks.

    Technically, as far as the I-864 is concerned, you can make an amendment (even submit a new form, including for a joint sponsor) omitting the information about your wife.
    If they insist on getting that info, it will be solely for purposes of finding out if she violated her status.

      To add to ExperienceIA's post,

      THe RFE was a simple request for more info justifying both your claims of income. Once the reviewer would examine your wife's proof of income and employment, they would simply disallow her participation in the sponsorship agreement if she could not provide proof of work eligibility.

      As suggested by the last response, you would also run the risk of your wife being scolded during the eventual interview, or even threatened for working illegally.

        I realize this is an issue but I accepted this from day one, that I would not lie to the USCIS.
        I actually met her while i was working at said workplace. In the interview, I would have to tell them I met her there, So i figured I should tell the truth from the beginning. The few lawyers I talked to said that it is usually forgiven since she is married now. If they would like me to pay fines, I would gladly do so, just to make sure I'm doing the right thing.

        I have submitted a new i864 with mine and my joint sponsors information ; 3 years of tax returns and paystubs. Thanks for the advice friends and wish me luck.
