Please help anyone about NVC and I-485

    You seem to be mixing I-131 for I-130. The I-131 is for "Advance Parole" or "Travel Permit." The I-130 is the immigrant petition, which you may have submitted initially.

    If submitting the I-485 after the I-130 has been submitted, you must include proof (receipt Notice of Action) of the I-130 with your I-485 package.

    I'm sorry for the double posts, I didn't see my first post so I posted again in a new thread then I realized since I am new my first post requires admin approval. In the other thread Yuzu suggests I message NVC to notify them I will proceed with i485 with USCIS, is this necessary, or should I just file the i485?

    Also I helped my friend who was in exact same situation I was in - he is American, wife is foreign, now they are both here in US- and I filed for him also just the i131 but he only sent about 2 months ago so he is still waiting for i131 approval, should he/can he update his i131 and send in now the i485 to be added or must he wait for i131 approval then proceed with i485 like I must do now?

      Yes you are right I meant i130. So I will go ahead and send i485 for my my wife and also my friends wife and I will include the i130 approval/notice of action respectively. Re Nvc should I notify them since they received my case from uscis?

        Hi syb388,

        My case and yours a lil bit difference, my husband from PRC become US Citizen, so i send a letter to upgrade my husband status and proceed with I-485.
        I think you better call NVC, told them you wanna proceed with I-485, and ask them if you need to send a letter.
        Because after i send my letter, i didnt received any notification from NVC, so 3 weeks later i called NVC and said i wanna proceed with I-485, and they make a notes on my case, so i didnt know if they received my letter and proceed it or not.

          Yes I know but the similarity is in the fact we both want to proceed with i485 after NVC has the case. Btw it's almost impossible to get through to them on the phone. In your case were you successful with the i485? From what Ray b says I think we don't need to notify the NVC and we can proceed directly with USCIS

            Yes i called them almost 2 weeks until they picked up my phone.
            My case still in process, but i just get my EAD card.

            Its said "All you have to do is just file Adjustment of Status application with USCIS. As USCIS already has your original petition, they will take care of everything and you don't need to do anything else"
