AOS for Parent of US Citizen (lost I-94)

  • AOS for Parent of US Citizen (lost I-94)

    Hello to everyone

    If possible can someone help to answer this question, I'm filing forms I-130 and I-485 along with the rest of forms for AOS, but I lost the form I-94, as prof of authorized entry I am sending the copy of the passport with the entry stamp and visa, but not sure if this will be sufficient, I was admitted in LA 16 years ago legally

    Do I need to request copy of the I-94 or just with the entry stamp and visa in passport is enough?, please advice, copy of I-94 takes about 3 months and $ 380,00, I would like to avoid this if possible

    Hi Luis,

    the main reason you can adjust status is the fact that you came in to the country legally with a visa and the only legal proof that exist is that I-94 you received at the airport .....
    I'm a USC and in the process of adjusting my wife's status myself (she's ready to schedule for interview as of feb18th) she also lost her I-94 and we have to file form I-102 for replacement.
    I heard some people just send the entry stamp and visa in passport but for some it was not enough and their cases were rejected but some people's cases were accepted but they still needed to have their I-94 for their interview so there is really no way for could avoid paying the replacement unfortunately

    it took 2 months for me to get my wife's I-94 replacement, it's usually 3

      Thanks for your replay, this is the information I was looking for, is better to be safe than sorry, if at one point I will be needing the I-94 doc is better to get it now, did you send your paper work with out it and latter showed the copy or you waited to get the copy to send it in the package ?

        Hello Luis,

        Have you tried to check it online, the I-94 record? But I doubt if your record, which is almost 16 years ago, is still available in their website. USD 380.00 is too stiff for an I-94 copy. My father's I-94 was retrieved and printed from their website, although his entry to US was only last year.
