Please advise me!! I applied for asylum in Virginia and I got married to U.S. citizen and moved to MN . I just filled adjustment of status and to my surprise I got called for asylum interview in Virginia one day after I submit a change of address . I guess that did not receive the update . I don't want to attend the interview . I want to proceed with my adjustment of status first but I don't want my asylum case to be clothed. Is there a way to tell them to hold my case? If there is where do I submit the request in MN or Virginia since I already filled change of address ?? Please help

Go to the Asylum interview. If you ignore it, you may receive a "voluntary departure" order. Also, your Adjustment procedure may be denied and the fees forfeited with an asylum procedure in process. You can't have two such procedures going at the same time.

Even if I go to the interview the Virginia office are not gonna do the interview because I moved to MN and they don't have jurisdiction over my case. They I'll move my case to MN so no point in going to the asylum interview . Is there a way to let them know to hold or reschedule my interview or to withdraw my asylum case and proceed with the adjustment of status ?

I'll say it again...go to the scheduled Asylum interview or risk being a "no-show" and getting a "voluntary departure" order. You cannot Adjust status and have an Asylum procedure going at the same time. If you ignore the preexisting asylum procedure and go ahead with the Adjustment interview, your Adjustment is likely to be denied because the Asylum procedure is not resolved.

Rayb thank you but you are greatly mistaken you CAN have asylum and adjustment of status going together it's on their law which was released on 2013 . I also confirmed that by calling Uscis . That is not my concern . My concern is to have my asylum as a back up plan. I have a right to withdraw my asylum case before any decision is made on it . But I don't wanna withdraw it. It's my backup planLast edited by tigy; 03-16-2015, 07:10 PM.
