  • What does the "Priority Date" Imply?

    Hi all,

    This may seem like insignificant queries; but would anyone be kind enough to explain

    1. What the "priority date" means and;

    2. Are our cases given a new priority date whenever there is a suspension due to an RFE?

    3. My specific situation is this: I got a case status update that my I-485 processing has been suspended due to more info required of me. Does this suspension mean that my other forms (I-130, I-765, I-131) has also been suspended?

    As usual, I appreciate your experiences

    Your priority date, is an individual place in line. The time you have to wait for an immigrant visa to be available.
    When you receive a RFE, the your case is stopped/suspended, until USCIS, receives what's requested. This can cause a delay in your case, therefore, the sooner you submit your RFE, the sooner your case gets back in line, for processing.
    Yes! All other matters/files, are also suspended.

      Thanks for responding MaryH. I understand everything except the part about getting back in line....does it then mean I will now get a new priority date after I respond to the RFE?

        When you are doing adjustment of status, your date to receive anything from USCIS. is not set in stone or fixed. Every case varies and done in a timely manner. Therefore, I don't think it's relevant to you.
        If some one is out of the country, they more likely get a priority date, as to when their case will start processing on it last final steps. Hope that helps.

          Understood Mary, it does help. I'm adjusting status, so pretty much whenever they receive the requested information from me, they will pick up my case where they left off.
