My girlfriend is an international student but she has being working off campus without a work permit and getting paid by check but now we are married. We trying to file her documents for adjustment of status. Can her application be rejected or approved without no penalties?

What ever you do, be truthful; and let the chips fall where they may. I know people who have listed their work in the Biography Form and no mention was made of it; so as much as USCIS, are not happy about anyone working with out proper authorization, I have never heard of anyone being penalized when the adjustment of status is filed. -
What I could advise you further, is for her to give up the job. Seriously, as her boss could be in great trouble and or penalties. With that being said, the risk of losing the job, would be eminent anyways.Comment
