  • Medical student loans on affidavit of support

    Hello all,

I am petitioning the USCIS for a green card for my wife. Our application is, ostensibly, solid. We are within two years of one another's age, have known each other for approximately three years, and have been married since August, 2014. My concern is financial. I have made 2-3 times the poverty level consistently for the past five years; however, I am about to enroll in medical school in August. I have a tuition waiver for school and 26 months of GI Bill monthly stipend remain (roughly equivalent to $28,000 in my area) for living expenses. Relatively speaking, I will be significantly ahead of the average doctor in terms of student debt load so I do not anticipate that being a point of contention in the interview. Does anyone have any informed opinions on how USCIS will perceive this in regards to our ability to support ourselves? Will proof of my financial aid package/credit report/GI Bill eligibility suffice to convince them that we are capable of supporting ourselves albeit with some student loans. Additionally, we have not received the temporary green card yet, but my wife has received her EAD and is currently working a near-minimum wage job. This will not, I believe, put us over the poverty line.

    Timeline:
    Married: August, 2014
J-1 Visa Restriction Waiver: Approved October 2014
    Receipt for I-485/130/765: November 22, 2014
    Biometrics: Completed December 31, 2014
Case has been pending interview scheduling since January 6, 2015

One last question, how do I determine which at which office we will interview?

Thank you so much, and best of luck to everyone.

You need documented proof of ongoing income which meets or exceeds the sponsorship guidelines. Use your GI bill stipend documents and bank statements showing the stipend amounts deposited.

The office of interview is determined by USCIS.
