  • I recieved a request for initial evidence (Help!)

    Hi,

    I am a F1 student, and I am married to American citizen. I applied to a green card and I have done all the work and submitted all the required forms. Now I received a yellow letter labeled as " request for initial evidence". They are requesting 3 things. First, for the forum I-864, they need a federal tax income from the petitioner and the sponsor. Second, they are asking for all the supporting tax documentation submitted to the IRS. Third, they are asking for evidence that we exceed 125% limit of the poverty.

    Now for the first problem, my wife prepared her tax form and we are going to send it. But, my question is, do I have to submit any tax forms? I have been in the US for 6 years but I have never had job and I do have scholarship,health insurance,monthly allowance from my government. I went to the IRS.gov and I think that I don't have to fill any taxes because my income and scholarship are from foreign resources, but today I heard that since I have been here for that long that I might have to fill some form. So Should I go and seek a tax adviser or I am good and I should send an explanation why that don't have to pay taxes?

    For the second problem, I am wondering what else we need to send as my wife filed her taxes through turbo-tax only, I mean is there any other documents we need?

    For the second problems, my father in law signed a new I-864 for me as joint sponsor, and he did send his birth certificate and his tax forum. So I think this is solved.

    Please help me in my questions, and let me know if I missing any thing else.

    Your wife is the petitioner and (primary) sponsor. She is required to submit at least the last year of federal income tax (form 1040) and W-2 (or 1099, or other proof of employment or source of income). If her 1040 income is higher than 125% of the guidelines, you should be fine. If not, she will need to add in her assets. If her assets are not enough, she will need to find you a secondary ("joint") sponsor -- your father-in-law, presumably.

    You are the beneficiary. You are not required to submit a tax return, unless you are requesting that your income be considered. If you are making no such request, then do not submit any tax return. You may have been required to file a return, but that is irrelevant to your present case.

      I did requested at the behining to includ my income/assets, but now ( since they are asking me for tqx forums that I dont have), we decided that my father in law will support us instead. So do I still need to worry about taxes since in the begining I did ask to include my income?

        To add to ExperienceIA's response to you,

        If you filed an income tax return for a recent year (2014 or 2013), submit a copy of it, in addition to your co-sponsor's documents. If you did not file an income tax return for 2014 or 2013, draft a statement explaining why you were not requried to file an income tax return, with an IRS citation copy, signed and dated.
