  • Filling I-140 + I-485, L1B Status is Going to Expire!

    Hi,

My query could be typical one but I am reading a lot about it in the web and things are confusing. So I would appreciate if someone can answer my queries.

    Story:
    - About to file I-140 + I-485 (EB2) concurrently, perhaps within the next two weeks.
    - My priority date is current.
    - Currently on L1B status (my family is on L2 status).
    - I-94 / L1 status will expire in mid August-2015.
    - My original L1 blanket petition (I-797) will expire in mid July-2017.

My attorney (through my company) is saying that we are looking for about 6-9 months for my I-140/I-485 to finish, and since my L1/I-94 will expire in August-2015, then I need to travel outside the US to apply for L1 extension at US Counselor abroad.

My question is what options do I have to stay and work in the US legally waiting for my I-485 to finish even after my I-94/L1 is expired? I want to avoid traveling outside US because of the cost and potential risk for L1 extension itself.

I have read in the web that if I have pending I-485 application, I can still legally work and stay in the US till USCIS decides on my application even if my L1/I-94 is expired. Is that correct?
