My girlfriend is traveling from overseas on a F1 Student Visa. She applied for the visa saying she would study at a short 9 week course that begins in July. We want to get married and I'm not sure I can fully afford the course.
I would like to get married and apply for a Adjustment of Status but I am worried about what the chances are she gets a green card denied and banned from the country. I lover her more than life herself and could not bear that pain in my life. The earliest she could arrive is around May 8th. If we get married and submit a Adjustment of Status and she does not attend class I assume that by June 1st the university will report her to ICE. Would the receipt from the I-485 be enough to keep them from arresting her? I don't want to get on the wrong side of immigration law but I have been dating her for over 3 year and given the situation could not see any other option in bringing her over and marrying her and being away from her for 3-6 months while waiting for a marriage visa application to run overseas was out of the question.
Is there anyway I can do to keep ICE from showing up at our doorstep without enrolling her in College? How negatively would applying for a F1 visa and not taking a class affect her green card application?
What is the best course of action here? How unsafe am I with her and protecting her from government goons if she does not attend college?
